Service
PrisPics provides photo printing, preparation, and mailing services for customers who want to send printed photos to recipients at correctional facilities. You are responsible for entering accurate recipient, identification, facility, and mailing address information.
No Affiliation
PrisPics is an independent private service and is not affiliated with, endorsed by, sponsored by, operated by, or acting on behalf of any correctional facility, prison, jail, detention center, mailroom, department of corrections, government agency, or recipient institution. All facility names are used solely for identification and delivery purposes.
Photo Rights and Permissions
By uploading photos or other content, you represent and warrant that you own, control, or have permission to use, reproduce, print, prepare, and mail that content through PrisPics. You are responsible for any rights, permissions, or releases needed for submitted content.
You are responsible for ensuring that uploaded content does not infringe copyrights, trademarks, privacy rights, publicity rights, or other third-party rights. You agree to indemnify, defend, and hold PrisPics harmless from claims, losses, liabilities, damages, costs, and expenses arising from or related to uploaded photos, submitted content, or your violation of these terms.
Photo Processing and Review
Uploaded photos and associated order information may be processed by automated systems and may be reviewed by PrisPics personnel when reasonably necessary for quality control, print production, customer support, fraud prevention, security, legal compliance, policy enforcement, troubleshooting, or service improvement. By using PrisPics, you consent to such processing and review as reasonably necessary to provide the service.
Prohibited Content
You may not upload illegal, threatening, harassing, exploitative, hateful, sexually explicit, or otherwise prohibited content. You may not use PrisPics to violate facility rules, court orders, or applicable law. PrisPics may refuse, cancel, or decline to mail content at its discretion.
Facility and Mail Delivery Limits
PrisPics' responsibility for mailing an order ends when the order is transferred to USPS or another mail carrier. Delivery dates are estimates only and are not guaranteed. PrisPics is not responsible for mail that is lost, delayed, misrouted, stolen, damaged, undelivered, or otherwise affected after it has been accepted by the carrier.
PrisPics is not responsible for delays caused by USPS, transportation providers, weather events, natural disasters, labor disruptions, equipment failures, facility lockdowns, government actions, or other events outside of PrisPics' reasonable control.
Correctional facilities, detention facilities, mailrooms, and recipient institutions set their own mail policies. PrisPics is not responsible for mail that is rejected, returned, destroyed, delayed, censored, withheld, or otherwise not delivered by a facility, mailroom, or recipient institution. Customers are responsible for providing accurate recipient information and ensuring that each order complies with the recipient facility's mail policies.
PrisPics does not guarantee that any facility will accept, deliver, or provide mailed photos to the recipient.
Payment and Orders
Orders are created after successful payment. Prices, shipping, and service availability may change. PrisPics may cancel or refuse an order when fulfillment is not reasonably possible or when content appears to violate these terms.
Limitation of Liability
To the fullest extent permitted by law, PrisPics is not liable for indirect, incidental, special, consequential, or punitive damages. PrisPics' total liability for any order is limited to the amount you paid for that order.
Force Majeure
PrisPics is not responsible for failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, severe weather, power outages, internet outages, labor disputes, government actions, transportation interruptions, pandemics, facility disruptions, carrier disruptions, or similar events.
Governing Law
These terms are governed by the laws of the State of California, without regard to conflict of law principles.
